5. HOW LONG IS YOUR DATA RETAINED?

storm-sport.com only keeps your Data for the duration necessary for the purposes set out in Article 3. This retention period is not the same depending on the Data in question, the nature and purpose of the collection being likely to vary this duration. Similarly, certain legal obligations impose a specific retention period. When you are subscribed to the Newsletter, we keep your email address until you unsubscribe.

When you contact storm-sport.com using the contact form or communicate with us by telephone, your data may be stored:

  • Up to one (1) year from the last contact if you do not have a customer account or an order made on the Site

  • Up to ten (10) years (Legal Duration) from the last order made on the Site, if this information concerns this order

  • In all other cases, the retention period for this exchanged Data may not exceed one (1) year.

 

With regard to your user account, all of your billing data is kept for ten (10) years from the date of purchase even in the event that you have made a request to deactivate your user account. :

If you make a request to delete Personal Data, your Site user account will be deactivated and anonymized, then completely deleted at the end of the aforementioned periods from the day you made the request. Finally, with regard to the Data collected by means of cookies or trackers, they will be kept for up to six (6) months for cookies or trackers measuring the audience and up to thirteen (13) months for the others. 1. Acceptance of the general conditions of sale

 

The customer acknowledges having read, prior to placing an order, the general conditions of sale set out on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relationship between 2CA ASSOCIÉS SAS and its customer. They will prevail over all other conditions appearing in any other document, except prior, express and written derogation from 2CA ASSOCIÉS SAS.

These general conditions of sale may be modified at any time by 2CA ASSOCIÉS SAS, without notice. The applicable conditions will be those in force on the site at the time of validation of the order.

 

2. Order

 

Automatic registration systems are considered as proof of the nature and content of the order. 2CA ASSOCIÉS SAS confirms the acceptance of its order to the customer at the e-mail address that the latter will have communicated. The sale will be concluded from the validation by 2CA ASSOCIÉS SAS of the payment of the order or the deposit, i.e. from the date of validation of the payment for orders paid online by bank card or from the date of receipt of payment by bank transfer or check. In any event, 2CA ASSOCIÉS SAS reserves the right to refuse or cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.

 

3. Price and payment

 

The price is expressed in Euros and all taxes included.

The price indicated on the product sheets does not include transport.

The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and EU countries. This price includes the price of the products, the costs of handling, packaging and storage of the products, the costs of transport, insurance and commissioning.

 

– By credit card bearing the acronym CB, allows you to pay via a bank server in a secure environment. After validation of the basket, the customer will receive a payment link from 2CA ASSOCIÉS SAS via Zettle.

 

– The order will be automatically canceled and the customer notified by e-mail in the event that the bank payment centers concerned have refused to give their agreement. 2CA ASSOCIÉS SAS has set up a procedure for verifying and requesting additional information from the customer, intended to ensure that the user of the bank card is its holder. The implementation of this procedure, which cannot be considered as a guarantee against any fraudulent use of bank card nor engage the responsibility of 2CA ASSOCIÉS SAS, postpones the validation of the payment until the end of the verification procedure. It may lead to the cancellation of the order.

Payments made cannot be considered as a deposit. Any late payment automatically entails the payment of late payment interest corresponding to one and a half times the legal interest rate.

4. Retention of title clause

​

By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of 2CA ASSOCIÉS SAS until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, whatever the cause, 2CA ASSOCIÉS SAS shall be entitled to demand the immediate return of the products at the customer's expense and risk.

5. Product Availability and Shipping

​

All deadlines announced on the 2CA ASSOCIÉS SAS website are in working days (excluding Saturdays, Sundays and public holidays). Each product sheet indicates:

– Either the presence in stock of the product concerned: the indication “in stock” corresponds to the stock status at 2CA ASSOCIÉS SAS  at the time of the order.

– Either an availability period: the availability period corresponds to the supply period in stock at 2CA ASSOCIÉS SAS. This deadline is communicated by the supplier and/or the manufacturer of the product and varies according to the type of product.

– Or the mention “pre-order”: the products concerned are new products announced by the supplier and/or the manufacturer, with no known date of availability.

– Or the mention “sold out”: the product is temporarily unavailable from our suppliers.

Orders are processed, prepared and shipped, i.e. delivered to our carrier, within 24/48 hours from:

– Receipt of the product by 2CA ASSOCIÉS SAS, with regard to products in availability,

– Validation of payment by the customer when it is made by credit card online or receipt of payments made by bank transfer or check, for products in stock at the time of this validation or receipt,

– Receipt of the products by 2CA ASSOCIÉS SAS, when they actually become available from the supplier, in the case of pre-order products.

In general, orders are processed after validation of payment when paid online by credit card or upon receipt by 2CA ASSOCIÉS SAS  of the payment when the customer has chosen payment by bank transfer or check. The indications “in stock” and the availability times are likely to vary between the date of the order and, depending on the case, the date of validation of payment by credit card or the date of receipt of the transfer or check. The availability times are also subject to change at the initiative of the supplier and/or manufacturer.
In such cases, the availability times will be those in force at the time of validation of payment by credit card or at the time of receipt of the transfer or check.
In case of unavailability of products from our suppliers:

– Permanent unavailability: 2CA ASSOCIÉS SAS undertakes to offer the customer replacement items or to reimburse the missing items, without delay and at the latest within 30 days in accordance with the provisions of article L121-20-3 of the Code of the consumption.

– Temporary unavailability: 2CA ASSOCIÉS SAS   informs the customer of the date on which the product will be available again. The customer then has the possibility of maintaining his order with these new deadlines or of canceling it. In the latter case, 2CA ASSOCIÉS SAS undertakes to reimburse the missing items without delay and at the latest within 30 days in accordance with the provisions of Article L121-20-3 of the Consumer Code. Shipments to overseas territories will be subject to acceptance of the package in the hold.

6. Delivery

​

Whatever the place of delivery, it is carried out in the time slot planned with the customer by the direct delivery of the product to the announced recipient. In the absence of any recipient, a transit advice note is left at the delivery address. The costs of new presentations are the responsibility of the customer. The customer is required to check the condition of the products upon receipt. In the event of damage, he must mention his reservations precisely on the delivery note, and reiterate them by registered letter with acknowledgment of receipt within three (3) days of delivery in accordance with the provisions of article L.133-3. of the Commercial Code. He must also inform 2CA ASSOCIÉS SAS  by registered letter with acknowledgment of receipt of any damage due to transport within eight (8) days of receipt. 7. Warranty

Any return must be preceded by the prior agreement of 2CA ASSOCIÉS SAS   and the allocation of a return number. Returns must be sent to:

In any case, the customer benefits from the legal guarantee against hidden defects (Art.1626 and following of the Civil Code). On condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (art. 1641 and following of the civil code).

8. Limitation of Liability

​

The information given on the site, photographs, product sheets, prices, etc. are given for information only. 2CA ASSOCIÉS SAS  strives to ensure the accuracy of the information presented on the site. Any errors that may have been introduced are fortuitous and are rectified as soon as possible. 2CA ASSOCIÉS SAS cannot be held liable for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. 9. Withdrawal

​

In accordance with the provisions of articles L.121-20 and following of the Consumer Code, the customer has 7 days from the date of delivery to return the product in its original packaging for replacement or refund. The return will only be accepted if the product has not been unpacked / used. Products sold in blister packs or with a guarantee label must be returned as is. Any return must be preceded by the prior agreement of 2CA ASSOCIÉS SAS and the allocation of a return number. The customer's return shipping costs will be at his expense, the reshipping shipping costs will be at the expense of 2CA ASSOCIÉS SAS. (According to the case)
